The Juvenile Justice Act in India
The Juvenile Justice (Care and Protection of Children) Act, 2015 is the cornerstone of child protection in India. It defines how children in need of care and protection are supported, ensuring their safety, education and overall well-being.
At TARA, all programmes operate under the framework of the JJ Act. Its principles guide daily practices, decision-making, and every interaction with children β ensuring full compliance with Indian child protection laws.
This page was developed following a workshop conducted with a social worker and children from TARA Homes, providing a practical and accessible understanding of how the JJ Act works in real life.
Legal framework
How Does Juvenile Justice Work in India?
The Juvenile Justice Act 2015 establishes the legal framework for children under 18 in India. It distinguishes between two categories:
- Children in conflict with the law
- Children in need of care and protection
Children supported by TARA fall under the second category. When required, they may be placed in a children’s home to ensure their safety and development β always under strict legal procedures, regularly reviewed to protect the child’s best interests.
The Role of the Child Welfare Committee
The Child Welfare Committee (CWC) is the statutory authority responsible for decisions related to children in need of care and protection. Each district in India has its own CWC.
The Committee evaluates each situation individually and determines the most appropriate support β including placement when necessary. It also ensures that organisations like TARA comply fully with the Juvenile Justice Act.
π‘ Every placement decision is regularly reviewed to ensure the child’s best interests remain the priority.

Monitoring and Follow-Up of Each Child
Every child is presented before the Child Welfare Committee at least once a year to review their situation and placement.
TARA also submits quarterly progress reports detailing each child’s development, achievements and any challenges faced. In case of significant events or concerns, the CWC is immediately informed to ensure appropriate and timely decisions.
- Regular contact with families β weekly communication encouraged
- 24/7 supervision by trained and qualified staff
- Dedicated night supervision with regular monitoring
- Suggestion and feedback system for children
- Specific attention to the well-being and safety of girls
